Agreement to Terms

By downloading, installing, or using Engineer Your Life ("EYL", "the App", "our Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Engineer Your Life ("we", "us", or "our") regarding your use of the App and any related services.

Description of Service

Engineer Your Life is a personal productivity and performance tracking application that helps you:

• Set and track goals and Must-Win Outcomes (MWOs)
• Build and monitor daily habits
• Schedule and manage focus blocks for deep work
• View health and recovery metrics from Apple HealthKit
• Receive contextual reminders (Clarity Nudges)
• Sync data across Apple devices via iCloud

The App is available on iPhone, iPad, Apple Watch, and Mac, and requires an active subscription for full access to features.

Eligibility

To use EYL, you must:

• Be at least 13 years of age (or the minimum age in your jurisdiction)
• Have a valid Apple ID
• Have a compatible Apple device running the required operating system version
• Agree to these Terms and our Privacy Policy

If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

Subscriptions and Payments

Subscription Plans

EYL offers the following subscription options:

• Monthly Subscription: $4.99 per month
• Yearly Subscription: $49.99 per year (best value)

Prices are in US dollars and may vary by region. Local taxes may apply.

Free Trial

Billing and Renewal

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings

Cancellation

You may cancel your subscription at any time through your Apple ID Account Settings. Upon cancellation:

• You will retain access to premium features until the end of your current billing period
• No refunds will be provided for partial subscription periods
• Your data will remain on your device and in iCloud (if enabled)

Refunds

All purchases are processed by Apple. Refund requests must be submitted to Apple directly through their support channels. We cannot process refunds directly.

User Conduct

You agree to use EYL only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices in the App
• Use the App to transmit malware or other harmful code
• Attempt to gain unauthorized access to our systems or other users' data
• Use automated systems or software to extract data from the App
• Resell, redistribute, or sublicense the App or any part thereof

Intellectual Property

The App and its original content, features, and functionality are owned by Engineer Your Life and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

• The "Engineer Your Life" name, "EYL" logo, and related marks are our trademarks
• You may not use our trademarks without prior written permission
• All user-generated content (goals, habits, notes) remains your property
• You grant us no rights to your personal data beyond what is necessary to provide the Service

Apple HealthKit

EYL integrates with Apple HealthKit to display health metrics. By enabling this integration, you acknowledge:

• You control which health data categories EYL can access
• Health data is only used to display metrics within the App
• Health data is never transmitted to external servers or shared with third parties
• Health data is never used for advertising or marketing purposes
• Your use of HealthKit data is also governed by Apple's terms

iCloud Sync

If you enable iCloud sync:

• Your EYL data will be stored in your personal iCloud account
• Data sync is governed by Apple's iCloud Terms of Service
• You are responsible for maintaining adequate iCloud storage
• We are not responsible for data loss due to iCloud service issues
• You can disable sync at any time in the App settings

Disclaimer of Warranties

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Results obtained from the App will be accurate or reliable
• Any errors in the App will be corrected

Health Disclaimer: EYL is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition. Health metrics displayed are for informational purposes only. Always consult a qualified healthcare provider for medical advice.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ENGINEER YOUR LIFE BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from unauthorized access to your data
• Any damages resulting from interruption or cessation of the Service

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Engineer Your Life and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

Termination

We reserve the right to terminate or suspend your access to the App immediately, without prior notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or third parties
• Is fraudulent or illegal

Upon termination, your right to use the App will cease immediately. Provisions that by their nature should survive termination shall survive.

Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms with a new "Last Updated" date
• Notifying you through the App or via email

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.

Dispute Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us. If the dispute is not resolved within 30 days, either party may proceed with formal dispute resolution.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Apple App Store Terms

These Terms are between you and Engineer Your Life, not Apple. Apple has no obligation to furnish maintenance or support services for the App. Apple is not responsible for:

• Product warranties (we disclaim all warranties as stated above)
• Product claims, including liability, consumer protection, or intellectual property claims
• Investigation, defense, settlement, or discharge of third-party claims

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Engineer Your Life regarding the App and supersede all prior agreements and understandings.
